Having entered Haas with an engineering background, he is planning to pursue either a strategy or business development role in the technology industry after graduating, or may explore the option of working in the tech practice of a consulting firm. mbaMission: When you were deciding where to pursue your MBA, what led you to choose UC-Berkeley Haas? And how has the school matched your expectations thus far? Haas First Year: The school’s culture really got me hooked. It was interesting to note that Haas had articulated its values and what it seeks in students so eloquently. On top of that, everyone I met seemed to embody those qualities. What I could only infer prior to admission, I know for certain now. Everyone is super down to earth, no matter how accomplished they are. Challenging [the] status quo and being students always are also principles that can be commonly observed. The MBA program office itself constantly strives to better the student experience by collecting feedback and acting on it. There are supplements such as courses on strategic innovation and even actual coding for the MBA students. Another important consideration for me was the strong experiential component of the program. HFY: I lived in the Bay Area prior to Haas, and this is one of the reasons I chose Haas. Of course the weather, the outdoor activities and the proximity to wine country are not bad perks, either, and Haasies make the most of it with the Redwoods@Haas  and the Wine Industry Club. mbaMission:  So how would you characterize your Haas classmates? HFY: Supportive, collaborative and humble. As I said, most of them exemplify the Haas principles  of “confidence without attitude” and “beyond yourself.” mbaMission:  Nice. And what would   you say about the greater community as a whole? HFY: The community itself is really tight-knit and has an intimate feel to it. mbaMission:  Great. What resources at the school do you feel have been the most helpful or interesting to you so far, would you say? HFY: Several events all year round, like the speaker series, and club events bring in experts and business leaders from the industry and academia, so there is never any dearth of interesting talks to go to. The clubs are all student run and really in touch with the needs of the student body. For example, there was a workshop to teach students how to write SQL queriesâ€"and that’s a skill that is needed for a lot of tech jobs. mbaMission:  Sure. That’s pretty cool. Have you had any interaction with the dean during your time at Haas? What impression would you say students seem to have of him? HFY: Dean [Rich] Lyons  is regarded very highly here. He was the one who really captured the essence of Haas in the culture and the four principles. Students have frequent access to him at events. For example, there is a breakfast with the dean once every few months. There is also a Dean’s Scotch Tasting  event in the spring with the Chatham House Rule  to encourage candid discussions. mbaMission:  That’s great. What has been your experience with the school’s alumni? Did you contact any Hass graduates before you got into the school, and have you reached out to any so far as a student? HFY: There are several alumni mixer events held throughout the year, and alums come in all the time for recruiting events as well as club events and talks. Before I was enrolled, I got a chance to network with alums at Haas admissions events as well. mbaMission:  Okay. What would you say are some of the best parts and perhaps less great parts of the school’s facilities? HFY: Being part of a crowded campus means that expansion of the current facilities is an issue. Classroom availability can sometimes become a problem, and meeting space can be hard to find. Having said that, we have just gotten access to a new facility within the new Memorial Stadium known as the i-Lab [Innovation Lab]. It is open space available to students to use and meet at whenever there is no class taking place. mbaMission:  That sounds like an important addition. What has been your favorite social event so far at Haas? Or is there one you are particularly looking forward to? HFY: Oh, wow, several. Orientation week was a whirlwind of activities culminating in a bomb-diggity ‘80s party. We usually have themed Consumption Functions  every two weeks, and the International Consumption Function as well as the Black History Month Consumption Functions were awesome events. VegHaas was another memorable eventâ€"several hundred Haasies descend on [Las] Vegas and take over several night clubs. The student treks are very popular as well. There are spring treks to Japan, Morocco, Israel and Cuba. mbaMission:  So what is the most important thing you feel more people should know about Haas? HFY: I think there can be a perception that Haas is just a tech school. This is absolutely not the case, and many of my classmates are looking at careers in finance, private equity, banking, energy and the social sector. The other thing that has been a pleasant surprise is how much the school cares about input from the students. Course feedback as well as identified curriculum development needs are dealt with in almost real time, something the students who are here for a short two years appreciate very much. mbaMission:  I can imagine. To finish up, which professors have you found particularly impressive thus far? Or is there anyone you are really looking forward to taking a class with? HFY: Sure. Well, there’s Cameron Anderson. I haven’t taken any classes with him yet, but his power and politics as well as his negotiations course are both very, very highly rated.  And I haven’t done the pricing course with Teck Ho  yet, since the course was completely bid out by second years by the time first-year bidding started, but I’m looking forward to it in second year. Terry Taylor  teaches the core operations course at Haas, and I can safely say that a lot of skeptics going into ops were blown away by Terry. He uses a variety of teaching tools, from regular cases to Seinfeld videos to supply chain games. For example, there’s one where we drink beer while managing a beer supply chain. All of the songs were purely instrumental and she was also accompanied by a grand piano, guitar, and other French horns during the performance. Although she seemed slightly nervous early on, by the end of the night, Ms. Uto seemed undaunted as she played her instrument with masterful skill. The venue utilized for the performance was the Recital Hall at Indiana State University. Which, in my opinion, was a great choice for its convenient size and impressive ability to clearly project the music to fully benefit the ears of the audience. For clothing, Ms. Uto dawned formal attire while her accompanying performers varied from formal to casual. The programs that were handed out gave historical information on each piece of music that was played. With information on when it was made and why some pieces were played the way they were; giving the audience some insight on what to expect. Therefore, they started selling their shares to Lum Chang Holdings (LCH), whose main motive was to take advantage of an existing public listed organization as a cover to tap into the thriving real estate marketplace in Southeast Asia.By the late 1990s, all the third generation sons had sold their shares to Lum Chang. The leadership issue got solved when Richard Eu, a 4th generation member, stepped up and volunteered for becoming the CEO after one of his uncle retired without naming a successor (Kohn 2014). Soon after Richard became the CEO, Lum Chang Holdings gained command over the company. This stalled all the initialgrowth plans formulated by Richard for the company for the time being.The merger plan between LCH and EYSH did not go well. In this situation, EYSH should have changed to sole proprietorship. The sole proprietor is entitled to the businesses profits and are responsible for the business debts and liabilities too. The ease of operating a sole proprietorship is a hugely popular aspect of business structure. They are relatively unburdened by administration regulations and can run a business autonomously without being liable to answer to associates, shareholders or board members.The owner himself controls all decisions and the profit (Carter 2016). Sole proprietors have the advantage of reporting income tax returns by their own individual tax returns, instead of facing all the lengthy documentation processes if filling as a business. EYSH got public listing on the Hong Kong Stock Exchange in 1992, and that was the origin of the dispute.The IPO documents did not clearly define the trademark issues that led to legal troubles. For the consecutive couple of years this controversial lawsuit intensified the family drama, and put the matter into the public spotlight, fully exhibiting the issue to the media and the paparazzi, naming Charles as the black sheep of the family business.The enquiries revealed that some of EYSHs products contained components derived from endangered species, which was illegal according to Hong Kong laws. The board members asked Charles to resign from the post of executive director and he was removed from the board too. His brothers also boycotted him and later Ri chard Eubought all his shares. The fourth generation of Eu descendants became the major shareholders of EYSH. Richard later took control of EYSH by the end of the 1990s, with the help of Robert and a project capital firm named MBO Partners. The lawsuit also was withdrawn and EYSH was de-listed from the Hong Kong Stock Exchange (Kumaretal. 2015). The decision taken by the board in Charles case was the appropriate one. The board of directors of an organization is made up to take a joint decision on any issue. Their skills and expertise are imperative for the decision making process (Blake 2016). They keep track of the regulations of the company, and also follow if those are being abidedbyor not.They are in charge of enhancing an organization's public representationand functionas a court of petition. After Richard Eu finally got the ownership rights of EYSH and changed it to EYSI, he started facing some trademark related issues. EYSI was the main trademark holder and EYSH was using the brand name for years to market the products. They demanded EYSI to grant them the right to use the name in Hong Kong too, for legal compliance. This led to legal disputes and ended up in a filed lawsuit against Richard Eu (Masood 2015). What we can learn from this trademark dispute is that we first need to judge and understand the risks of collaborating with any company in any given country. The collaborating parties should understand all the clauses in the agreements and be aware of all the statutory requirements. Everything has to be in pen and paper and properly documented. The parties should check their legal rights in the licensing context, and the owner should be lawfully registered. The laws are multi-faceted and must be analyzed properly. In case of overseas trade all the clearance procedures have to be properly explained and carried out (Horowitz and Horowitz 2015). Another lesson that we can learn is that any business should not use any unregistered trademarks, or trademarks for which they have not obtained rights. Right conflicts are bound to arise and are dangerous. Unregistered trademark owners face the issue of not being properly protected by law. They are at a risk of facing infringement notices, at their home country or in any location they wish to expand. What is needed is a trademark attorney who would help with these regulations. Just because an organization is using a brand name of its mother company does not mean it can demand legal right over it. The original company can file a lawsuit against this non-registered companies (Nandini and Reddy 2016). Another thing to keep in mind is that protection of creations or products is necessary. For that, a properly owned registered trademark licence is needed. With the license registration, the competitors are alerted that another company has a claim on the product, or the brand. A registered license also enables smooth expansion of the product. The company should clearly state the trademark rules in their agreements and official documents for partners and employees to be aware of them (Meng and Ma 2014). Conclusion We find two conflicting situations in the Eu Yan Sang company. We can see how a company has grown from a small shop to a big corporation that provides remedies and medications to the world's biggest economy. Since its enlisting the company has delivered only double digit expansion and enjoys the biggest market share in its sector. This will serve as a great advantage to the country especially since it is also geared toward hard sciences and technology. This will increase its labor force and the IT outsourcing industry will in turn serve a wider English-based clientele. The government promotes the new growth of industries that will replace manufacturing. China can easily use the outsourcing industry to leverage. Since it is people intensive and is an emerging industry, it can be used by China to achieve its goal of sustained self-reliance and an upwards economic growth. China boasts of good infrastructure as compared to its competitor, India, and can therefore utilize this as an asset. In order to ensur e copyright protection, China has adopted strong copyright laws that protect against intellectual copyright infringement. Cultural ties have worked to China’s advantage especially when serving countries in the Asian region. Such countries include Japan which is the world’s second largest economy. It still remains un-penetrated and therefore China remains its primary service provider. Weaknesses are those factors that place the company at a disadvantage over its competitors. iSofstone realized that they needed to penetrate into the Japan and Korea markets. In order to make up for this weakness, Mr. Juro Nakauchi, a former cooperate advisor for iSoftstone was recruited back into the company. His role was to become chairman of the Japan and Korea business group where he would focus on strategic business development and management. This recruitment however presents a certain risk to the company. Competitor companies recognize the value of Mr. Juro and are putting forth eff orts to woo him into their companies. His loyalty may change due to competitive salary packages. The League of Nations The League of Nations was an international organization that existed between 1920 and 1946. Headquartered in Geneva, Switzerland, the League of Nations vowed to promote international cooperation and preserve global peace. The League achieved some success, but it ultimately was unable to prevent the even deadlier World War II. The League of Nations was the predecessor to todays more effective United Nations. Goals of the Organization World War I (1914-1918) had caused the deaths of at least 10 million soldiers and millions of civilians. The Allied victors of the war wanted to form an international organization that would prevent another horrific war. American President Woodrow Wilson was especially instrumental in formulating and advocating the idea of a League of Nations. The League arbitrated disputes between member countries in order to peacefully preserve sovereignty and territorial rights. The League encouraged countries to reduce their amount of military weapons. Any country that resorted to war would be subject to economic sanctions such as a halt to trade. Member Countries   The League of Nations was founded in 1920 by forty-two countries. At its height in 1934 and 1935, the League had 58 member countries. The member countries of the League of Nations spanned the globe and included most of Southeast Asia, Europe, and South America. At the time of the League of Nations, nearly all of Africa consisted of colonies of Western powers. The United States never joined the League of Nations because the largely isolationist Senate refused to ratify the Leagues charter. The official languages of the League were English, French, and Spanish. Administrational Structure The League of Nations was administrated by three main bodies. The Assembly, composed of representatives from all member countries, met annually and discussed the priorities and budget of the organization. The Council was composed of four permanent members (Great Britain, France, Italy, and Japan) and several non-permanent members who were elected by the permanent members every three years. The Secretariat, led by a Secretary-General, monitored many of the humanitarian agencies described below. Political Success The League of Nations was successful in preventing several small wars. The League negotiated settlements to territorial disputes between Sweden and Finland, Poland and Lithuania, and Greece and Bulgaria. The League of Nations also successfully administered the former colonies of Germany and the Ottoman Empire, including Syria, Nauru, and Togoland, until they were ready for independence. Humanitarian Success   The League of Nations was one of the worlds first humanitarian organizations. The League created and directed several agencies that were meant to improve the living conditions of the worlds people. The End of the Organization The members of the League of Nations knew that many changes within the organization had to occur after World War II. The League of Nations was disbanded in 1946. An improved international organization, the United Nations, was carefully discussed and formed, based on many of the political and social goals of the League of Nations. Lessons Learned The League of Nations had the diplomatic, compassionate goal of generating permanent international stability, but the organization was unable to avert conflicts which would ultimately change human history. Thankfully the worlds leaders realized the Leagues shortcomings and reinforced its objectives in the modern-day successful United Nations.

Sexual Harassment and Abuse Essay Based on this week’s reading, what are the delimiting factors which determine whether or not an individual is experiencing sexual harassment or sexual abuse? In your opinion, how prevalent are these offenses and what is an appropriate response? Unfortunately in our society, we have been gradually increasing sexual liberties in the ways we dress, talk, and act in any and every public venue. This sexual liberation from both genders has helped to blur the boundaries of sexual harassment. Balswick and Balswick define sexual harassment as â€Å"any form of unsolicited language or touching containing sexual overtones. It includes sexual jokes, suggestive talk and unsolicited physical advances (Balswick and Balswick, 2008). † Based on that definition and what I know of many work places, especially hospitals, outsiders could perceive that sexual harassment is alive and well on any given day. Though many of those sharing sexual jokes and innuendos would adamantly deny that they were harassing anyone, they could not deny that they shared unsolicited material. They chose to verbally pass along what they found to be funny from their experiences or mind, while simultaneously failing to consider how the information may be received and perceived by those listening. Generally, those that object are thought to be sensitive people and are excluded from future exposure. Most institutions and work places today have established grievance policies for anyone that perceives they are experiencing sexual harassment. The boundaries of sexual abuse are clearer than the boundaries of sexual harassment. Sexual abuse is more profound, affords greater injury to the victim, and carries stiffer consequences for the perpetrator. Balswick and Balswick define sexual abuse as â€Å"a sexual act imposed on a child or person who lacks emotional, maturational, and or cognitive development (Balswick and Balswick, 2008. Balswick and Balswick use the terms sexual abuser and sex offender interchangeably. Thus, for me the scope of the definition of sexual abuse should be broadened. Sex offenders exist that rape and sexually abuse women who are not lacking emotionally, maturationally, or in cognitive development. They were merely overpowered or feared for their lives, yet, the abuse they suffered was strictly sexual in nature. Victims of sexual abuse often carry the weighted burdens of shame and unwarranted guilt in addition to numerous other negative emotions, hurts, feelings of betrayal and abandonment, physical trauma, and more. Though I believe more people report their experiences today than perhaps earlier decades, I believe that many never report; perhaps because of the time that has elapsed between the abuse and the time they feel safe enough to report; perhaps they feel they would heap on more personal shame by exposing a family member or that now their spouse and children would be hurt by the revelation; perhaps there are innumerable personal reasons for failing to report past abuses and hurts and maybe for the individual they are better dealt with in private counseling even if it negatively impacts our statistics. I believe our responsibility should be guided by helping the injured rather than punishment or seeking vengeance against the perpetrator. I am reminded of God’s Word to us in Psalm 82, â€Å"Defend the weak and the fatherless; uphold the cause of the poor and the oppressed. Rescue the weak and the needy; deliver them from the hand of the wicked (NIV). In Ephesians 4 Paul includes some instructions for living as Christians, â€Å"Do not let any unwholesome talk come out of your mouths, but only what is helpful for building others up according to their needs, that it may benefit those who listen. And do not grieve the Holy Spirit of God, with whom you were sealed for the day of redemption. Get rid of all bitterness, rage and anger, brawling and slander, along with every form of malice. Be kind and compassionate to one another, forgiving each other, just as in Christ God forgave you (NIV). † Finally, Paul reminds us in Romans of Jesus instruction, â€Å"Do not take revenge, my dear friends, but leave room for God’s wrath, for it is written: ‘It is mine to avenge; I will repay,’ says the Lord. On the contrary: ‘If your enemy is hungry, feed him; if he is thirsty, give him something to drink. Crisis Management Crisis communication is one of the most important and neglected components of organizational communication in today's business world. It is vital that every corporation have contingency plans for emergency situations, both natural and man-made. Studies show that eighty percent of organizations confronted with a major disaster runs out of business within two years.(Hickman & Crandall 1997) Nevertheless, we also know that almost forty percent of all Fortune 1000 companies have an operational crisis management plan in place. (Hickman & Crandall 1997) This paper will examine and evaluate three journals that discuss different aspects and needs for an active crisis plan. The first journal evaluated comes from an article in Business Horizons named "A Multi-faceted Approach to Crisis Management" that discusses the need for developing many parallel plans before disaster strikes. First and foremost, the article says that a crisis management team must be created for the mere anticipation of possible crisis events in order that recovery and rebuild of the organization may be conducted in an efficient manner. The team should be named and move into action. The first order of business for the new team should be developing worst case scenarios. In order for this next step to happen, the team must establish what business functions are mission critical and necessary for the survival of the organization. They must also understand and plan for the proper technology needed to back up these functions to be in place. After all of this is completed, the team needs to develop and distribute to all those involved a crisis management plan.
